Class Action Lawsuit information: Nissan Transmission Failures – Altima, Maxima, and Quest Vehicles

A 2005 Nissan Altima owner just wrote into my website reporting transmission problems for the past two years. While I listed some class action lawsuit information on this in a previous article, now I found the link to the lawyers website who are handling this case. Here is their info:

The class action lawsuit against Nissan is currently open and in the discovery stage of litigation, according to Chimicles & Tikellis’ website. Also according to their website:
The complaint alleges that Nissan Maxima (MY 2004-06), Altima (MY 2005-06), and Quest (MY 2004-07) vehicles with the 3.5 liter V6 engine and Aisin RE5F22A 5-speed automatic transmission may contain a design defect causing them to be predisposed to transmission slippage, premature clutch wear, overheating, and other problems that ultimately result in serious and expensive damage to the vehicles’ transmission.
So if you own one of these vehicles and are experiencing transmission problems, you should contact the lawyers above immediately.

In addition, there are three San Francisco Bay residents who are suing Nissan for a hidden defect that caused breakdowns for their 2002 Pathfinder, 2003 Altima and 2003 Pathfinder. According to the article, “Jennie Anderson, a lawyer for the plaintiffs, said they want to expand their suit to a class action on behalf of all Californians who bought 2001 through 2005 models of Nissan Altimas, Pathfinders or Sentras. Had my maxima 05 going on 4 yrs now and so sick and tired of it! Got it when it had 79,000 miles on it and at 90,000 miles had to replace transmission. Now at 102,000 miles it is still shifting gears! sumthing needs to be done!!

I feel your pain. I own a 06 Murano and the driver’s seat broke while I was driving. My warranty is gone and all Nissan has done was weld the seat which broke again. The frame needs to be replaced because this is a costly repair they take the cheap way out. I could have had an accident due to this issue. Nissan won’t step up and admit that they have certain issues with different models. Someone has to die before anything is resolved. I have contacted the NHSTalong with the BBB and Consumer Affairs. I then contacted the attorney generals office of the problem.

Maximas a pieces of crap. I have an 05. I replaced the transmission at 90,000 and now my second transmission is going. Never again will I buy a Nissan. They suck.

Usually in class action lawsuits, the lawyers are working on a contingent basis, meaning they will take a percentage, sometimes 33 1/3% or more, if they win — therefore they usually only take cases they think they can win. Hence, no upfront fee. Watch A CIVIL ACTION or ERIN BROCKOVICH — while not about car lawsuits, it’s similar.
However I also believe in the case of car lawsuits, the lawyers get paid their fee on top of the winnings from the manufacturers in some cases.
Since your car appears to be part of the lawsuit, you should contact them to be a part of it. Good luck.

I bought a 2004 nissan quest brand new from the dealership. It was the biggest mistake I ever made. The tires were worn out by 20k miles, the passenger slinding door did not work right, all the overhead air vent covers were falling off, the brakes needed to be replace by 25k miles. the air conditioner blows hot air at 50k mile, the front struts were replace by 60k miles, at 65k miles the engine was make alot of noises and the car shudder at 60 mph. It has 110k miles now and the car runs like crap. My wife doesn’t want to drive it cause she feels unsafe. We will never buy any nissan vehicle again.

I have 2003 Nissan Sentra i bought from the dealership in 2006. I was only aware of one recall for the ecm when my car stopped unexplainably and i was upside and could not get another car so for years i had to deal with my car stopping, replacing the headgasket, more ecm issues. I didnt know until i decided to look online that it was a real manufacturer error with my car. It is true and now i have called Nissan again that my car has stopped again and now isn’t running. Its older but reading websites really shows me this was a real problem.

Y0 tambien tengo un 2006 nissan maxima queTiene ProBlemas con la trasmission. Va como una semana que Yva por la caretera . De repente el transmission esta asiendo muncho ruido luego el carro esta para este tiempo fuera de control pege algo fuerte es un poste de luz. Me lastime la espalda,pierna,y braso. No compren nissan de el 2004 a 2007….BLAS GONZALES HUMADA….
I also have a 2006 nissan maxima with the same problem the transmission. I was driving on the freway when i heard this noise under the car by that time i had hit a pool the car went out of control so people dont buy nissan from 2004 to 2007. Drive safely. BLAS GONZALEZ AHUMADA

Lets us all call for a governmental investigation into the NHTSA officials, to eitner clear or indict them for possible bribery from nissan or jatco for not to pushing for recalls on 30+ million bad cvts. There is no other explanation for such ongoing neglect of the wreckless endangerment & lack of pursueing justice for nissan murano owners!

I bought a 2004 Nissan Maxima, My husband spent every penny we had purchasing the car. We did not get the car home and the transmission went out in the car as well as the radiator. The dealer that sold us the car knew that the transmission was no good. The car had to sit until we could come up with 4000.00 to get a transmission. We did not even have an hour to enjoy our new car. Nissan needs to be sued and compensate all of us for the money and time that we have spent in these car. People always say that you cant go wrong with a Toyota, Nissan, or a Honda. Nissan did me wrong this time.

I bought a 2005 Nissan Altima 3.5 5 months ago and so far I’ve had my alternator replaced now i need a control arm replaced and my motor and transmission is making loud knocking noises …….. I’m so pissed off i can’t afford this and When i found out i needed an new alternator the car would just shut off while i was driving i was on the highway when this happened to me with my children in tow

I have a 2013 Nissan altima had my transmission, air conditioner motor, replaced last year, compliments of Nissan. Today my car was towed problem with ignition, key-less entry, they still don’t know whats wrong. I have owned Nissan in the past, never had a problem. I am very frustrated with the 2013 Altima that I own.

I own 2007 Quest. Bought it brand new in 2007. The mileage is now closed to 190000. I’m experiencing transmission slippage. I thought it was because of bad engine mounts. Replaced all engine mounts and transmission is still slipping.

I bought my car in 2009 had never ran good always poping when switching gear and pops when driving sensor light crank sensor. Aweful car and now transmission blew. I got thid because I had an 1999 nissan altima I loved never a problem well this one awful awful and I still owe $9000

We have a 2007 nissan quest with 3.5 v6 engine. It has been slipping bad . We’ve had it 3 1/2 years and it’s too expensive to fix. Although we’ve maintained all up keep of this vehicle I hate it!!! The transmission should not be doing this after such a short time.

I bought a Nissan Altima 2013 four months ago. I have had to take the car back to the dealership twice due to shuttering and shaking while driving and sitting idle. On the second occasion to the dealership, they told me that I needed a new transmission and put me in a loaner car. However, they installed a refurbished transmission without my permission or knowledge and tried to lie about it. The car is still shaking and general manager told me that this is normal. I am too through with this car and I want my money back. Who can I contact to find help with this problem.

I too have transmission problems on a nissan 2007 altma.. Kingston NY replaced the transmission in 2009 47,000 mile… well it went again and almost got KILLED .. stopped dead in its tracks.. NEVER BUY A NISSAN EVER AGain.. I wish I could have gotten killed … MAY BE THEY WOULD FIX THERE DESIGN FLAW

We own at 2013 3.5 SL Altima that has had its 3rd transmission replaced. I just spoke to Nissan about the issue and that the 3rd transmission is too starting to act up. As we all know it has to be doing it regularly for the dealer to be able to find there is a problem between 20 and 40 mph the transmission shutters as to uncertain what gear it actually is in many times when you hit the gas there is no response as the computer seems to be at a loss as to what to do. Each time the dealer has been good to replace the transmission but with 42,000 miles how many more will have to be replaced. It appears Nissan has yet to solve the problem and is mearly waiting for warranty to go out. With all the problems I’ve read and heard about the CVT transmission you would have thought Nissan would have done something other than wait the consumer out

I would suggest contacting a lemon law attorney in your state ASAP, because they’ve had several chances to fix the transmission issue and haven’t. If the car is still within the manufacturer’s warranty, you may have a case. It’s my understanding most work on a contingency or get paid their fees from the manufacturer when they win, so there should be no cost to you.

2009 Rogue transmission problems. Nissan expanded their warranty to 10 years 120k, so they know it is bad. My issue, Tranny goes out at 91k, they warranty it then it goes out again at 130k. It Iasted 38k miles and Nissan will not do a thing about it. Says it is out of warranty. Nice replacement, lasts 38k miles!

Stay away from the Nissan CVTs
2009 Nissan Altima, bought this car with 60,000 miles, noticed a surging with the CVT transmission. The dealership said it was the way they are and there was no fix to it. We drove the car surging for two years. Then while on a trip, the car stops pulling all together. After we cut the car off and restart it,it ran fine for another hour. Now it won’t get over 30 mph downhill and stops all together going uphill. The dealership says the transmission has to be replaced. There are not repairable and must be replaced. The average cost of replacement is $4300. Nissan has extended the warranty on these CVT transmissions because of so many problems but you have to be under 120,000 miles. We are just over that. Thanks, Nissan. If you know there is a problem, you should take care of it no matter the mileage. Some people drive more miles than others. This is absurd. I will never buy another Nissan product.

I purchased a 2005 Nissan Maxima November 2015…and I’m having some major transmission problems…I also have a lien on the vehicle for 3 more years…My rpms go way above speed and it causes me to have a hard stop…It also jerks back and forth while I’m in drive….This problem has been going on for about 10 months…just recently my vehicle broke down and all Of the transmission fluid leaked out all on the ground in a big puddle….so I ended up having to have it towed to my house….I can’t afford to pay the lien and do transmission repairs…..they expect us to pay for these cars for 5 yrs.and don’t last as long as a few months or few years.
